Subject: Multiple Army violations of Federal Law

Sir unfortunately I find myself writing to you to inform you that the Army and individuals under your command are blatantly and intentionally in violation of Federal Regulation of which I will be providing you the evidence of.   Since the beginning of the year I have submitted multiple FOIA requests to your organization.  I will only be presenting a few of these to document the violations and to allow the evidence to be more focused.  Although I have submitted multiple requests to the individuals and organizations involved I have yet to receive a single correspondence from any of them in response which I will also be providing documentation to substantiate. Sorry this will be lengthy since there are a lot of issues to address. 

Two individuals should be singled out deserving much of the credit or blame for requiring me to write to you.  Neither individual has responded to a single correspondence sent directly to them in regards to FOIA submissions  Status requests are covered by Federal Law and so far the Army has failed to comply numerous times which I will be further expanding on. The two predominant individual breaking federal regulations are:

I submitted my first FOIA request and received a letter the 22 Jan 2020 Letter (Attachment 1) from Mr. Turner assigning it the Reference Number of FP-20-008904/FA-20-0007 within the 20 days as required by law.  It stated that my request would be sent to Mr. McDowell.  I then received the 28 Jan 2020 letter from Mr McDowell stating the Reference Number assigned was FP-20-0005 (Attachment 2) and that they would not be able to respond within the FOIA's 20-day statutory time period. This is important.  The Army stated in writing that it is required to meet a 20 day statutory time period with a submission.

So this brings us to the first FOIA violation in this correspondence.  If you will notice the Reference Numbers provided are not in agreement.  So I wrote Mr. McDowell on  02 March 2020 inquiring about this inconsistency.  First to find out which number was correct and second to as to the status of my submission.  I never received a response which is a violation of FOIA.  I then wrote Mr. McDowell on 24 Apr 2020 (Attachment 3)  with the same request and also referencing my 02 March 2020 letter. I have yet to receive a response from Mr. McDowell which is clearly in violation of FOIA.

I submitted another FOIA request to Mr. Turner which was assigned FOIA Reference Number FP-20-010021/FA-20-0009 (Attachment 4).  This was referred to:

I have never received any correspondence from USAG Installation Management Command Human Resources Directorate which is clearly in violation of the FOIA 20 day statutory time period which has been acknowledged by the Army itself in Attachment 2.  I sent correspondence inquiring to both Mr. Turner about this failure and to USAG Installation Management Command Human Resources Directorate.  I am only attaching the one to USAG sent 2 Mar 2020 (Attachment 5) to which neither USAD or Mr. Turner have ever responded.  I repeat never.

I then submitted two more FOIA requests to Mr. Turner one on 17 Feb 2020 (Attachment 6) and on 25 Feb 2020 (Attachment 7) neither of which I received any response.  Clearly violating of the FOIA 20 day statutory time period on both submissions.  Following this up I have submitted them multiple times and wrote Mr. Turner about this on 02 Mar 2020 and 29 Mar 2020 (Attachment 8) since it is the latest the only one I'm supplying. Violating FOIA multiple times in multiple aspects.   Mr. Turner has yet to provide any correspondence to my multiple submissions or status requests.

I have brought this numerous and  perpetual violations of FOIA to you since none of the individuals Mr. Turner or Mr. McDowell will respond to any of my correspondences nor the USAG Installation Management Command Human Resources Directorate.  Your assistance would be greatly appreciated in this matter.  I look forward to hearing from you soon in this matter.  Please feel free to contact me if I can be of assistance.

I have submitted multiple Freedom of Information Requests which have been assigned to your organization I have yet to received any correspondence on.  Even though I wrote you 2 March 2020.

First off AMC FOIA office designated my 13 Jan 2020 request as FP-20-008904/FA-20-0007 but the letter I received from your organization designates it as FA-20-0005.  So if you could please provide me with the correct designation for future communications I would appreciate it. 

I have yet to receive any correspondence for (designated by AMC 31 Jan 2020) FP-20-010022/FA-20-0010.  You currently appear to be delinquent in responding to this request within the required time period.

This is my second attempt to contact you sending correspondence on 2 March 2020

If you could please address these issues I would appreciate it and provide a status of the other FOIA request that have been assigned to your organization.

I am submitting this Freedom of Information Request for all Government documentation in connection to the army failure to meet RTCA DO-178 (all revisions) Software Considerations in Airborne Systems and Equipment Certification.  This is to include airborne software contracted to DO-178 or not.  Including all government generated documentation addressing the fact the Army do no meet DO-178 yet the FAA requires it for operation in public airspace by Federal Law.  This would include all emails (internal or external), correspondences, any material used or generated in conjunction to this subject; e.g. briefing or meeting material.  This would also include any material related to software Airworthiness Impact Statements (AWIS).  All documentation and communicates related to any Army airborne software failing to meet DO-178 and failures relative to any software AWIS over the longest allowable time period.  Please feel free to write me if I can be of assistance.

I am submitting this Freedom of Information Request for the technical and regulation requirements documentation and corresponding traceability documentation for Enterprise Process Improvement and Collaboration [EPIC] (as of 2019) software engineering process under contract being developed by System Simulation, Software, and Integration Directorate (S3I), Aviation and Missile Center, Combat Capabilities Development Command (CCDC), Army Futures Command.  This development was being overseen by Phillip Howard and Susan Davis.  The requirements document(s) specifies and delineates Army regulations and technical requirements EPIC is required to meet.  Included in this request is the corresponding traceability documentation for the requirements documentation provided.  There should be no difficulty in the Army providing the current revision of this document within the time specified by FOIA since it is just a matter of providing a copy of the current documents.

Since the beginning of the year I have submitted multiple Freedom of Information requests to the Army.  I have as yet received any correspondence concerning two of my submissions provided to you.  Both are attached (Attachment 1 & 2).  These being 17 Feb 2020 and 25 Feb 2020 FOIA submissions. 

 

Also I have not received any correspondence from USAG Installation Management Command, Human Resources Directorate Administrative Services Division regarding FA-20-009.  I wrote them about this on 2 Mar 2020 see Attachment 3.  I also wrote you concerning this as well 29 Mar 2020 Letter.

 

If you could address this I would appreciate it.  Please advise. Feel free to contact me if I can be of assistance.
